NY State DMV bans "Choose life" License plates

Says "Choose life" expression would trigger "road rage"

Last week the New York State Department of Motor Vehicles officially rejected a specialty license plate request from The Children First Foundation - a nonpartisan charitable organization that promotes adoption and safe havens - on the basis that their copyrighted logo is "patently offensive". CFF's logo (shown above) is a crayon drawing of two smiling faces, a boy and a girl, and the words "Choose life". CFF's purpose, message and website at the bottom of their plate is "Fund-Adoption.org".

The Children First Foundation's president and co-founder Elizabeth Rex, Ed.D. was contacted by the Hudson Valley Coalition for Life and she explained the disappointing setback. "We had fully complied with suggestions made by the DMV and were led to believe that our application would finally be approved. When the DMV unexpectedly turned around and rejected our plate for the third time, our attorneys immediately filed a federal lawsuit to protect our civil rights."

According to Alliance Defense Fund attorney Michael Johnson in an August 5 World Net Daily posting, "New York Department of Motor Vehicles officials and their superiors have apparently decided that it's just fine to deny The Children First Foundation's applications simply because they don't like the organization's message. We intend to demonstrate that it's not just fine with the Constitution." The DMV has notified Johnson that they have voluntarily suspended their custom plate program until further notice.

The "Choose life" plates have sprung up around the country. In 2003, Connecticut became the ninth state - and the first in the northeast - to approve the "Choose life" plate thanks to the efforts of The Children First Foundation. "There are now over 50,000 "Choose life" license plates on the road in ten different states across the nation," said Rex. "In just four years `Choose life' plates have raised over $3 million dollars to help support adoption. It's a great plate with a very important cause."

HVCL's co-sponsorship of the Women's Equality Day, Reformed event marking the anniversary of women's suffrage met with similar blocking tactics last year when the group applied for use of the Westchester County Office Building Rotunda for the annual ceremony. Eventually Ms. Regina Riely took Westchester County to court on First Amendment violations. The threat of an injunction allowed the ceremony to take place and she received a financial settlement in 2004 by the County. The irony in this is that Dr. Elizabeth Rex is the scheduled keynote speaker for this year's August 26 event. She should have a lot to say about equality in old New York.
