ADMISSION OF NON-RESIDENT STUDENTS
Amendment First Reading - August 28, 2002

The Board of Education affirms that its primary responsibility is to provide the best possible educational opportunities for the children who arc legal district residents and who are of legal age to attend school

However, a non-resident student may be admitted to district schools upon payment to the district of the Board-adopted tuition charge. if and only if, in the judgment of the Superintendent of Schools,

I there is sufficient space to accommodate the non-resident student,

2 the non-resident student meets the district's criteria for admission,

3 no additional staffing will be necessitated by admitting such students, 4 no other substantial costs will accrue as a result, and

5. the admission of such non-resident student is and continues during the

enrollment period to he in the best interests of the district.

The Superintendent of Schools shall annually review the approval of the attendance of non-resident tuition-paying students.

Future Residents

Non-resident students shall be admitted to the Bedford Public Schools when the parent or legal guardian can show a contract has been entered into for the construction of a home in the district, that a lease has been signed for the rental of a house in the school district, or that a contract for the purchase has been consummated and that such a dwelling will be occupied by the parent or the guardian within five months of application of opening of school or a reasonable time thereafter as determined by the Superintendent of Schools. In the event that such a house is not occupied within the designated period, the student will be permitted to complete the year only, but tuition will be paid for the period the child was not a legal resident. Should there be any possibility of the parents not occupying the dwelling within the five-month period, the Superintendent shall require a bond covering the tuition for that portion of the year during which the student's status was that of non-resident.

Former Residents

A student who becomes non-resident after May 1st may continue for the remainder of the school year in the school which he/she has been attending without payment of tuition

A student who has completed three years of high school -- grades 9, 10, 11, and who moves out of this district thereafter need not pay tuition for his/her senior

year providing hardship is proved and he/she receives the recommendation of the Superintendent

A student who becomes non-resident after the opening of the school year stay he permitted, in the discretion of the Board, to continue for the remainder of the school year in the school which he has been attending upon payment of tuition on a pro rata basis

Residents of Other School Districts

Residents of other school districts may be admitted to the Bedford Public Schools on a tuition basis if a contractual agreement is made between the respective Boards of Education.

Children of Staff Employees

It shall be the policy of the Bedford Central School District to permit the children of full time employees who are not residents of the community to attend the schools of the district, where space is available in an appropriate instructional grouping and where acceptance of such children will not result in any significant additional cost to the district Such assessment will be made prior to the beginning of each school year, and the decision to admit a student shall be for that school year only. Each employee who lives outside the district shall be responsible for the transportation of his/her child

Transportation

Subject to the prior claim of resident students to transportation service, transportation on any district bus trip over a regularly established bus route may be provided for non-resident students by obtaining a certificate from the Superintendent authorizing the transportation requested between specified points on bus trips specified. Such certificate may be terminated at will in the event that granting of bus privileges to non-resident students cause overloading of a bus trip

Tuition

Tuition for non-resident students shall be set each year by the Board using the formula recommended by the New York State Department of Education

Proration of Tuition Charge for Contract Pupils

Where non-resident contract students enter or leave during the year the per pupil tuition charge shall he prorated.

Note: Prior policies, 5152 and 5152.2, revised. Included in the policy are the  factors which will be considered in admitting non-resident pupils. It is important to include factors for allowing out of district residents into the school in the policy. In addition, these factors must be uniformly applied to all non-resident students seeking admission into the district.

ADMISSION OF NON-RESIDENT Student's Regulation Student Addresses: Verification and Investigation

I The address of the parents must be the address of residence for each student If' a student claims residence with a person other than his/her parent(s), evidence of legal guardianship must be presented

2. Should a student's address change at any time during his/her enrollment, residency must be confirmed by an acceptable document, a g., a lease, a utility bill, a voter registration card.

3 If a student's address is not the address of his/her parent(s) or legal guardian(s), the Building Principal shall consult with the Attendance Office to confirm the procedures used in determining the student's current address. The Attendance Office shall then investigate and provide specific evidence of the child's false claim to residency

If the evidence indicates that a student's address has been purposefully changed in order for him/her to attend a school in a district other than the one he/she is legally entitled to attend, he/she shall be immediately transferred to the appropriate district

5. Student admission shall not be delayed pending verification of the address A verification and/or investigation shall take place after student admission has been effected,
